RE:  Schmill v. Liberty/Montana State Fund; WCC No. 2001-0300

Pursuant to Mr. Luck’s request for a telephone conference call, Judge Shea has agreed to conduct a telephone conference next Tuesday, November 21, 2006, at 9:00 a.m.  Please confirm that you will be available for this conference call.

Additionally, I am copying this e-mail to the Schmill e-mail list and request that if any other party is interested in participating, they contact the Court.

As you are aware from previous telephone conferences, the Court has 5 outgoing telephone lines in which we can conference in other parties.  If there are more than 5 parties interested in participating, they will either have to appear in person or confer with each other to convene at central locations to be included in the conference.

Thank you.

The only counsel directly on the case are Laurie, Larry and I but it seems like several people remain active on all common funds.  The timing is complicated by the fact that the briefs are due in the first instance on 12-8 I think so there isn’t a lot of leeway. If we need to be briefing we need to get to work since everything seems to get complicated around the holidays (and the Griz-Cat game, the biggest holiday of them all).

I suspect that Laurie can (and would rather) verbalize her objections than write a brief.

Brad,

I will forward your e-mail and the attached motion to the Judge.

Who are all the counsel that need to be included in the phone conference?  Do you wish to have the conference prior to your motion for stay being fully briefed?
